Legal Responsibilities - Association Programs
TO: ALL CONVENTION SPEAKERS AND PROGRAM CHAIRPERSONS
FROM: PMA LEGAL COUNSEL
RE: LEGAL RESPONSIBILITIES - ASSOCIATION PROGRAMS

1. This convention is conducted by a tax exempt trade organization, which has as its primary objective the improvement of photographic business conditions. Association convention programs must, therefore, be relevant to the issues of the day and should face these issues squarely. We must also be extremely careful that it is completely impartial and objective in its programming responsibilities. Therefore, it is essential that all speakers take special care to avoid any reference or interference that might be considered unjustly, detrimental or advantageous to a specific commercial product. The convention platform can and should be used candidly to carefully and fully cover and investigate all problems and issues facing the photographic industry. Extreme care should be taken so that no one in the audience can legitimately claim that the platform was used for an individual firm or product sales presentation or was used to unjustly criticize any firm or product.

2. Discussions must, of course, avoid areas where control or coercion of the following appear:
A.  
WHAT or how much anyone can manufacture, buy or sell,
B.  
The PRICE at which members can buy or sell,
C.  
WHO shall manufacture, buy or sell, and
D.  
WHERE anyone shall manufacture, buy or sell.
